Welcome to the latest Williams Graham Carman video blog. This installment will look at divorce proceedings, how they work and what you might need to know.
Once a couple have entered into a legal marriage, they can only dissolve that union through a divorce, or by having the marriage annulled.
In order to qualify for a divorce, you will have to demonstrate you have been separated from your partner for a minimum of 12 months. After this point, you can apply to the courts for a divorce.
Proving you are divorced can be tricky. The easiest way is to live separately from your partner, although it is also possible to share a home and still be considered separated.
As part of a divorce, you will need to divide your shared assets like savings and property, as well as putting in place a plan for any children.
Once these issues have been addressed, the courts will grant a divorce order. This will be finalised one month and one day after it is first issued.
